We are developing a tool that allows you to generate a Form 6 for most superannuation funds so that you may apply to the fund for information for family law purposes.
The calculator provides calculation of the interest adjustment on a base amount. For accumulation funds, you insert the return rate. For defined benefit super and self managed super, the calculator inserts the prescribed interest rate, according to the rate determined by he Australian Government Actuary. The Full Court in Bulow & Bulow [2019] FamCAFC 3 (18 January 2019) held that the trial judge should have evidence of the nature, the form and the characteristics of the superannuation interest as well as evidence about the effect of any order being sought so that the trial judge is able to determine the overall justice and equity of the orders.
An expert superannuation report will provide the necessary evidence in line with Bulow’s case. It will also provide evidence across a range of percentages or base amounts for any order that is being sought.
