Stephen Bourke is the author of SuperSplitting for Family Lawyers (2011), the leading text on the splitting of super.

The textbook covers all the essential information on the super splitting legislation including a dedicated chapter for self managed super. Other topics are the design of orders and agreements as well as the trustees responsibilities.

It is an excellent summary of the super splitting laws complete with tips and traps. It is a must have for any practitioners who practice in the area of family law.

SPLITTING DOCUMENTS FOR ACCOUNTANTS & SMSF TRUSTEES

After an SMSF split, practitioners should inform the administrator (usually the accountant) for the self-managed super fund and SMSF Trustee (usually the parties) about the need for SMSF Family Law documents under the SIS Regulations.  The documents are mandatory.  Penalties may apply if not completed.

The Documents List contains:

  • Relevant family law notices
  • Other relevant forms including trustee forms as well as member and non-member spouse forms
